In the labyrinth of financial transactions and tax filings, a seemingly minor discrepancy such as a name mismatch between your Permanent Account Number (PAN) and bank account can lead to significant delays in receiving your income tax refund. Despite the successful filing of your Income Tax Return (ITR), this hiccup can halt the refund process, leaving taxpayers in a bind.

Understanding Income Tax Refunds

Income tax refunds are issued when the taxes paid exceed the taxpayer’s actual liability. This could be due to excess TDS (Tax Deducted at Source), advance tax payments, or other reasons. "Income tax refund means a refund amount that is initiated by the income tax department if the amount paid in taxes exceeds the actual amount due," explains the income tax department’s official website as of July 12, 2024.

The Crux of the Name Mismatch Issue

The root of the problem lies in the verification process. Refunds are issued to pre-validated bank accounts through the Electronic Clearing Service (ECS), necessitating a match between the name in the bank account and the name in PAN. "It is crucial for individual taxpayers to ensure that the bank account details provided are valid, the correct PAN is linked to that account, and the bank account is pre-validated at the income tax portal," states Mihir Tanna, Associate Director-Direct tax at S.K Patodia & Associates LLP.

Tanna shares an anecdote of a client who faced a refund delay for FY 2022-23 (AY 2023-2024) due to a discrepancy between the name on the PAN and the bank records. The issue was eventually resolved by updating the PAN records and reapplying for the refund, which was then successfully credited.

Resolving the Name Mismatch

To tackle this issue, individuals are advised to align their bank account details with their PAN card information. Kanishka Chaudhary, CFO at Suryoday Small Finance Bank (SSFB), recommends updating bank account details to match the PAN card by providing necessary identification documents to the bank. CA Pranjal Bansal of A A P T & Associates highlights that even slight variations in the name can trigger this error, emphasizing the need for vigilance.

For Hindu Undivided Families (HUF), the situation demands even more precision as the tax department scrutinizes every letter, including the designation "HUF" in both PAN and bank account names.

Interest on Delayed Refunds

Interestingly, taxpayers are entitled to interest on eligible tax refund amounts under section 244A, at a rate of 0.5% per month or 6% per annum. However, Tanna notes, "There will be a loss of interest on refund for the period in which the refund cannot be credited due to name mismatch, as the delay is not attributable to the income tax department."

Moving Forward

For those caught in the name mismatch conundrum, the solution lies in either updating the name in the PAN or the bank account. Tanna advises opting for the easier and quicker fix, which often involves updating the bank account details.

The ordeal of a delayed tax refund due to a name mismatch serves as a cautionary tale for taxpayers to ensure their documents are in sync. With careful attention to detail and prompt action to rectify discrepancies, taxpayers can avoid unnecessary delays and smoothly navigate the process of claiming their income tax refunds.
